MLS Clear Cooperation and New Privacy Listing Type

Effective May 1st, 2020 within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants.  Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public-facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public.   • adds transparency to the homebuying process

  • ensures fully informed sellers about market exposure

  • ensures buyers have equal, fair opportunity to buy

  • helps avoid liability issues when there is a limited exposure without full disclosure

  • public should not be more informed than MLS members

  • by holding MLS membership, all agree to cooperate

  • purpose of the MLS is to facilitate efficient marketplace

  • eliminates the need to hunt for pocket listings, track coming soon lawn signs, Zillow listings or social media posts to know what properties are on the market

A new “Privacy” listing type will be implemented to meet the mandatory submission requirement, satisfy the privacy needs of the seller, and promote cooperation among brokers.
