What is Mediation?

 

Mediation is a process in which a neutral person (the mediator) is hired to facilitate discussion and negotiation between parties in dispute. The mediator cannot impose a result on the parties; that is, the parties must voluntarily agree to make the results of the mediation binding. The Santa Barbara Association of REALTORS® does not endorse any particular mediator or form of mediation.

Pros and Cons of Mediation

 

One advantage of mediation is its flexibility. Unlike court proceedings, which are bound by strict procedural rules, mediation allows parties to customize the process to suit their unique needs and circumstances. Mediation sessions can be scheduled when and where is most convenient to both parties involved. The parties usually have the freedom to choose a mediator with expertise relevant to their particular dispute. This flexibility can lead to more efficient and effective resolution of conflicts, saving time, money, and stress for all involved. Mediation helps foster open communication and collaboration. It can often lead to creative solutions that address underlying concerns and interests.

While mediation offers several benefits, there can be some drawbacks you may need to consider. The voluntary nature of mediation means that either party can choose to withdraw from the process at any time, potentially leading to unresolved disputes and wasted time and resources.
